Safemails.Net — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Safemails.Net services and software, including the Safemails Gmail Chrome extension (“Extension”), any related websites, applications, APIs, support, and documentation (collectively, the “Services”).

By installing, accessing, or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

You must comply with applicable laws and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of any credentials you use with the Services and for all activity under your account.

Subject to these Terms, Safemails.Net grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business or personal use (as applicable).

You retain all rights to your Customer Content. Safemails.Net does not claim ownership of your Customer Content.

4.2 Processing instructions

You control what you choose to encrypt or process through the Services. You are responsible for ensuring you have the right to use and process Customer Content (including recipient permissions where required).

4.3 Service-generated data

The Services may generate operational data such as logs, diagnostics, and basic usage metrics to operate, secure, maintain, and improve the Services (“Service Data”). Service Data does not include the plaintext of your email messages unless you explicitly provide it to support.

Our Privacy Policy explains how we collect, use, and protect data related to the Services: Privacy Policy (or your current published privacy policy URL).

6. Security and responsible use

You agree not to use the Services in ways that could compromise security, including attempting to defeat cryptographic protections, tamper with message flows, or disrupt recipient access. If you discover a vulnerability, please report it to security@safemails.net.

7. Support and updates

Safemails.Net may provide support via email, documentation, or other channels. Support scope and response times may vary by plan. We may deliver updates, patches, and new features from time to time. Some updates may be required for security or compatibility.

8. Fees, billing, and taxes

If you purchase a Subscription, you agree to pay the fees described at purchase or in an order form. Fees are non-refundable except where required by law or expressly stated in writing. You are responsible for applicable taxes.

9. Third-party services

The Services may integrate with third-party platforms (e.g., Google services such as Gmail). Your use of third-party services is governed by their terms and policies. Safemails.Net is not responsible for third-party services or outages.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEMAILS.NET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SAFEMAILS.NET DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEMAILS.NET WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEMAILS.NET’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO SAFEMAILS.NET FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR EUR 100 IF YOU HAVE NOT PAID ANY AMOUNTS.

12. Indemnification

You will indemnify and hold harmless Safemails.Net and its directors, employees, and partners from any claims, liabilities, damages, and expenses arising out of your use of the Services, your Customer Content, or your violation of these Terms or applicable law.

13. Term and termination

13.1 Term

These Terms apply while you use the Services or maintain a Subscription.

13.2 Termination

You may stop using the Services at any time. Safemails.Net may suspend or terminate access if you violate these Terms, if required by law, or to protect the security and integrity of the Services.

13.3 Effect of termination

Upon termination, your license ends and you must stop using the Services. Sections that by their nature should survive termination (including Disclaimers, Limitation of liability, Indemnification, and Governing law) will survive.

14. Changes to the Services or Terms

We may modify the Services and these Terms from time to time. If changes materially affect your rights, we will provide reasonable notice (e.g., by posting on our website or via email/in-product notice). Continued use of the Services after the effective date means you accept the updated Terms.

15. Governing law and dispute resolution
